Russel D. was commuting to work, lane sharing at 20 mph in heavy traffic, with his 2004 Aprilia RSV 1000 motorcycle on the 57 Freeway in Brea, California. A driver of a Chevrolet Volt decided to change lanes over double yellow lines from the Number One Lane into the HOV lane sideswiping Russel D. causing him to be ejected from his motorcycle.

The Injuries

Russell D. sustained serious injuries including a right comminuted (crushed) femoral head/hip fractures. Russel D. was underwent surgery at UCI Medical Center where he was in the ICU for seven (7) days. Russel D. was then transferred to a rehabilitation Hospital for an additional fourteen (14) days.

The case

The driver’s insurance company disputed liability claiming Russel D. was travelling at an “Unsafe Speed”. Tom Reinecke was able to prove that in fact Russel D. had been traveling at a rate of 20 miles per hour.
