On May 3, 2018, Mr. Robert B., age 63, was riding his motorcycle northbound on Mission Bay Drive in San Diego, California. At that time, a motorist was driving their vehicle southbound on Mission Bay Drive when they made the election to make a u-turn to get back on the freeway. As a result, the motorist’s vehicle collided with Robert B. and his motorcycle.
Robert B. sustained multiple rib fractures, pneumothorax (collapsed lung), left ankle tibia and fibula fractures and multiple abrasions. Robert B. underwent surgery and physical therapy. Robert B. was in the ICU at Scripps Medical Center, San Diego for fifteen days and then at a rehabilitation hospital.
As the driver at fault’s insurance company failed to accept liability (when it was crystal clear), pay for Robert B.’s motorcycle damage or inform us of their insured’s policy limits, Robert B. hired Tom Reinecke and he aggressively prosecuted the case on behalf of the client. The insurance company and their defense attorneys disputed liability and aggressively fought the case filing numerous motions including ones to prevent the taking of the driver’s deposition. In turn, Tom Reinecke filed multiple motions to compel the motorist’s deposition and discovery. Tom Reinecke prevailed and won all motions. A trial date was set and Tom Reinecke was successful in resolving the matter.
